These terms govern your use of the Avermond website and service. Last updated: 13 July 2026.
Avermond (“Avermond”, “we”, “us”) is an online test-preparation service operated by Concrete Dynamics UG (haftungsbeschränkt), Westendstraße 15, 87439 Kempten (Allgäu), Germany (see our Legal Notice). These Terms of Service form a contract between you and Concrete Dynamics UG when you create an account or purchase access. By using the service, you accept these terms and our Privacy Policy.
Avermond provides original online practice materials for the TOEFL iBT® test, including mock tests, practice exercises, progress tracking, and optional AI-assisted feedback and estimated bands for writing and speaking. A limited amount of content is free; further content requires a paid plan.
TOEFL® and TOEFL iBT® are registered trademarks of Educational Testing Service (ETS). Avermond is independent and is not affiliated with, authorised, sponsored or endorsed by ETS. Our tests are practice materials only; they are not official TOEFL® tests, and any scores or bands are practice estimates, not official ETS scores. We do not register you for, or issue results toward, the official test.
You must provide accurate information and be at least 16 years old (or have the consent of a parent/guardian). You are responsible for keeping your login credentials secure and for activity under your account. One account is for one person; please tell us promptly at support@avermond.com if you suspect unauthorised use.
Prices and what each plan includes are shown on our Pricing page and at checkout, in the stated currency and inclusive of any applicable VAT. Payments are processed by Stripe; we do not receive or store your card details. The “Practice Pass” grants access to the paid content described at the time of purchase. Any promotional discount (e.g. a code) applies as shown at checkout. We may change prices for the future, but never for a purchase you have already made.
The paid content is digital content supplied without a tangible medium, made available to you immediately after purchase. As a consumer in the EU you normally have a 14-day right of withdrawal. Because we provide access immediately, at checkout we ask you to expressly consent to immediate provision and to acknowledge that you thereby lose your right of withdrawal once performance has begun (§ 356(5) BGB; Art. 16(m) of Directive 2011/83/EU). AI-assisted bands and feedback are automated study aids generated with the help of third-party AI providers. They judge the content and language of your responses, and for speaking the measured pace of your delivery; they do not assess pronunciation or accent. They may contain errors and are not official scores or professional advice. You should not rely on them as a prediction of your official TOEFL® test result. How your responses are processed is explained in our Privacy Policy.
You may use Avermond for your own personal test preparation only. You must not: copy, record, scrape, redistribute, publish, resell or share our content or your account; attempt to bypass the paywall or access controls; upload unlawful content; or interfere with the security or operation of the service. Institutional/multi-student use is only permitted under a separate institutional plan or agreement.
All content on Avermond — passages, questions, transcripts, audio scripts, feedback rubrics, design and code — is the original work of Concrete Dynamics UG (haftungsbeschränkt) and is protected by copyright and other rights. We grant you a limited, personal, non-transferable, revocable licence to access and use the content for your own preparation while your access is valid. All other rights are reserved.
We aim to keep the service available and accurate but provide it on an “as reasonably available” basis. We may update, suspend or discontinue features, and perform maintenance. Some features (for example audio recording and speech-to-text transcription for speaking, where your recording is uploaded to our speech-to-text provider) depend on your browser and device and may not be available everywhere.
To the extent permitted by law, Concrete Dynamics UG (haftungsbeschränkt) is liable without limitation for damages arising from injury to life, body or health, for intent and gross negligence, under the Product Liability Act, and to the extent of any guarantee expressly given. For slight negligence we are liable only for the breach of an essential contractual obligation, and then only for the foreseeable damage typical for this type of contract. Any further liability is excluded. Statutory consumer rights remain unaffected. We are not liable for outcomes of the official TOEFL® test or any admission, visa or other decision.
You may stop using the service and delete your account at any time from your account or by emailing support@avermond.com. We may suspend or terminate access if you materially breach these terms (for example by sharing or reselling content), where possible after notice. Deleting your account does not automatically entitle you to a refund of a one-time purchase beyond what the Refund Policy provides.
We may amend these terms for good reason (e.g. changes in the service or the law). We will publish the updated version here with a new date and, for material changes affecting an ongoing relationship, notify you by email. Continued use after the changes take effect constitutes acceptance.
These terms are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law does not deprive you of the mandatory protections of the law of your country of habitual residence, and you may bring claims in the courts there. For business customers, the place of jurisdiction is Kempten (Allgäu), Germany.
